1. Who we are

• These Terms of Use govern your access to and use of the WV-App website and application (together, the Service).
• The Service is operated by WV-App Pty Ltd, REG 2025/171754/07, of 3 Bettina Close, Lansdowne, WC 7780, South Africa, email: info@wv-app.com.
• By accessing or using the Service, you agree to these Terms of Use. If you do not agree, you must not use the Service.

2. What the Service does

• The Service provides tools to help you view and track your financial accounts and investments in one place.
• The Service aggregates and displays information from accounts you connect or upload (for example, bank, broker, or other financial accounts).
• The Service is provided for general information and organisational purposes only and is not tailored to your personal circumstances.

3. No financial advice

• The Service does not provide financial product advice, legal advice, tax advice, or any other form of professional advice.
• Any information, projections, or summaries displayed by the Service are for general information only and should not be relied on as the basis for investment or other financial decisions.
• You are responsible for your own investment and financial decisions and should obtain independent professional advice before acting on any information obtained through the Service.

4. Eligibility and accounts

• You must be at least 18 years old and capable of entering into a legally binding contract to use the Service.
• You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
• You must notify us promptly if you suspect any unauthorised access to your account.

5. Acceptable use

You must not:

• Use the Service for any unlawful purpose or in a way that violates any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Service or any other systems or networks.

• You retain all rights in your data. You grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and display your data solely for the purpose of providing and improving the Service.
• You are responsible for ensuring that any data you provide is accurate, lawful, and does not infringe the rights of any third party.

7. Service availability and changes

• The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
• We may modify, suspend, or discontinue any part of the Service at any time, including features, functionality, or availability, with or without notice.

8. Fees and cancellation

• If you use a paid plan, the applicable fees, billing cycle, and payment terms will be described on the Service or in a separate agreement.
• We may change fees from time to time. Any changes will apply from the start of your next billing period, after notice is provided.
• You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time.
• Fees are non-refundable except as required by law or as otherwise stated in writing by us. We do not provide refunds or credits for partial months or years of service.
• If you cancel your subscription, your data will be retained in accordance with our Privacy Policy and may be deleted after a reasonable period as described in that policy.

9. Intellectual property

• We (or our licensors) own all intellectual property rights in the Service, including software, design, text, graphics, and logos.
• You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for your personal use and in accordance with these Terms of Use.
• You must not copy, modify, distribute, or create derivative works from any part of the Service except as expressly permitted by us.

• The Service may rely on or link to third-party services (such as account aggregators, banks, brokers, analytics providers, pricing and valuation providers, or cloud hosting providers).
• Those third-party services are governed by their own terms and privacy policies, which you should review. We are not responsible for the content, performance, or security practices of third parties.

11. Disclaimers

To the maximum extent permitted by law:

• We make no representations or warranties about the accuracy, completeness, or timeliness of any information displayed in the Service (including balances, positions, or valuations).
• Data may be delayed, incomplete, or incorrect, and you should always verify important information with your financial institution or adviser.

12. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any loss of profits, loss of opportunity, loss of data, or any indirect or consequential loss arising out of or in connection with your use of the Service.
• Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms of Use is limited to the greater of: (a) the fees you paid to us for the Service in the 12 months before the claim, or (b) ZAR 15,000.

Nothing in these Terms of Use limits your rights under the South African Consumer Protection Act 68 of 2008, where they apply.

13. Indemnity

You agree to indemnify us against any loss, liability, damage, or expense arising from:

• Your breach of these Terms of Use.
• Your misuse of the Service.
• Any claim that your data infringes the rights of a third party.

14. Termination

• You may stop using the Service and close your account at any time.
• We may suspend or terminate your access to the Service at any time if we reasonably believe you have breached these Terms of Use, or if we stop offering the Service.
• On termination, your right to use the Service ends, but sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will continue to apply.

Our handling of personal information is described in our Privacy Policy, and our use of cookies is described in our Cookie Policy. These policies form part of these Terms of Use. By using the Service, you consent to our collection, use, and disclosure of personal information as described in the Privacy Policy.

16. Governing law

These Terms of Use are governed by the laws of the Republic of South Africa. You submit to the non-exclusive jurisdiction of the courts of South Africa and the courts of appeal from them.
